Terms & Conditions

Trailer Spare Parts Australia Pty Ltd
(“TSP Australia”, “we”, “us”, “our”)


1. Prices & GST

  • Prices are subject to change without notice.

  • All prices are in Australian Dollars (AUD) and are subject to 10% GST, unless stated otherwise.


2. Orders & Payment

  • Orders are confirmed once payment is received or accepted in writing by TSP Australia.

  • Payment must be made in full prior to collection or dispatch unless a trade account has been approved in writing.

  • Special order or custom-made items cannot be cancelled once production, machining, or procurement has commenced.


3. Returns & Refunds

  • Goods may only be returned with prior approval from TSP Australia.

  • Requests for returns must be made within 7 days of the invoice date.

  • Returned goods must be unused and in original packaging.

  • Return freight costs are the responsibility of the customer unless otherwise agreed.

Non-Returnable Items

  • Special order items (items made or ordered to customer-specific requirements)

  • Custom-machined, assembled, fabricated, or modified products

These items cannot be returned for credit or refund, except where required under Australian Consumer Law.


4. Fitment & Compatibility

  • Customers are responsible for ensuring that all goods purchased are suitable for their specific trailer, axle, suspension, brake system, or intended application.

  • All measurements, specifications, bearing sizes, stud patterns, and compatibility details must be confirmed by the customer prior to ordering.

  • TSP Australia is not responsible for incorrect selection, fitment, or application of goods based on customer-supplied information or assumptions.


5. Installation & Use

  • Goods supplied by TSP Australia may be installed by a suitably qualified person or by the customer, provided installation is carried out correctly and in accordance with applicable Australian Standards, manufacturer guidelines, and legal requirements.

    TSP Australia is not responsible for damage, injury, or failure resulting from:

    • Incorrect installation

    • Misuse or modification

    • Overloading

    • Use outside the intended purpose


6. Custom Machining & Tolerances

  • Custom-machined or fabricated items are produced within normal industry tolerances.

  • Minor variations in dimensions, finish, or appearance do not constitute a defect.

  • Once machining or fabrication has commenced, orders cannot be altered or cancelled.


7. Customer-Supplied Information

  • Where goods are manufactured, modified, or supplied based on information provided by the customer (including measurements, drawings, specifications, or verbal instructions), TSP Australia is not responsible for errors, incorrect fitment, or performance issues arising from incorrect or incomplete information.


8. Freight & Delivery

  • Goods are shipped using a freight provider of our choice unless otherwise requested. Freight costs are added to the invoice.

  • Freight transit times vary depending on destination.

  • Orders are booked with freight or courier companies within 7 working days after payment confirmation.

  • All delivery dates provided are estimates only.

TSP Australia is not liable for delays caused by freight providers, customs clearance, weather events, or circumstances beyond our control.


9. Damage, Loss & Claims

  • Risk passes to the customer once goods leave our warehouse.

  • TSP Australia does not accept responsibility for goods lost or damaged in transit unless additional freight insurance has been requested and paid for.

  • Customers must notify TSP Australia in writing within 14 days of the expected delivery date if goods are damaged, faulty, or not received.

  • Failure to notify within this period may result in no replacement or refund being issued.


10. Insurance

  • Insurance is the responsibility of the purchaser once goods leave the warehouse.

  • Optional freight insurance can be arranged at the customer’s request and cost.


11. Freight Authority

  • By requesting delivery, the customer authorises the freight carrier to leave goods at the nominated delivery address if unattended, unless otherwise instructed in writing.

  • Once delivery is marked as completed by the carrier, the goods are deemed delivered.


12. Product Images & Descriptions

  • Product images are for illustration purposes only.

  • Actual products may vary slightly in appearance, finish, or packaging without affecting performance or function.


13. Online Store Pricing Errors

If a product is incorrectly priced due to human error or website malfunction:

  • TSP Australia will notify the customer as soon as possible.

  • The customer will have 3 days to choose either:

    • A full refund, or

    • To proceed with the order at the corrected price.


14. Warranty & Australian Consumer Law

  • Goods are supplied with guarantees under the Australian Consumer Law (ACL).

  • Manufacturer warranties apply where provided.

  • Warranty does not cover:

    • Incorrect installation

    • Misuse, overloading, or modification

    • Lack of maintenance

    • Normal wear and tear

To the extent permitted by law, TSP Australia is not liable for labour, installation, removal, downtime, or consequential losses.


15. Safety-Critical Products

  • Trailer components are safety-critical products.

  • Regular inspection, maintenance, correct loading, and compliance with road regulations are the responsibility of the customer.

  • TSP Australia is not responsible for failures resulting from overloading, misuse, or lack of maintenance.


16. Technical Advice

  • Any technical advice or assistance provided by TSP Australia is general in nature and provided in good faith.

  • The customer remains responsible for confirming suitability, compliance, and safe application.


17. Title & Ownership

  • Ownership of goods does not pass to the customer until payment has been made in full and cleared.

  • Until payment is received, goods remain the property of Trailer Spare Parts Australia Pty Ltd.


18. Payment Disputes & Chargebacks

  • Customers agree to contact TSP Australia directly to resolve any concerns prior to initiating a chargeback or payment dispute.

  • Unjustified chargebacks may result in recovery of associated fees and costs.


19. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia, and any disputes will be subject to the jurisdiction of Queensland courts.
